Terms and Conditions


You are contracting with Corporate Guru. Any person(s) ("Users") who Uses www.corporateguru.co.za (the "Website") agree to be bound by these terms and conditions that shall apply to the use of the Website ("Terms"). If you do not agree with these Terms, do not continue to use the Website. This Website is owned and operated by Corporate Guru. Use of the Website shall be subject to these Terms and your continued usage of the Website indicates your agreement to these terms.

2. Products & Services Advertised

2.1. Corporate Guru does not take any responsibility any Service or Product or quality thereof supplied by the Advertisers.2.2. All Advertisers are required to have a Website to support validity of the product or Service.

3. Errors

3.1. The Advertiser is responsible for the content and quality of their Advertisement. Advertisements should be uploaded according to the specifications supplied.

4. Agreements of Sale

4.1. Advertisements are paid for One (1) month in advance by means of Debit Order.
4.2. The Advertiser undertakes to have sufficient funds in their account for payment of the Debit Order on the selected date.4.3 Should a Debit be returned a re-run will be attempted within 3 working days. Should the debit order return a second time as unpaid the Advertisement will be removed from the website.4.4 The Advertisement can be replaced by following the normal Registration process. 4.5 Please note: The availability of Banner positions is strictly on a first-come, first-serve basis and availability of Banner positions cannot be guaranteed (in the event of cancelled Banner advertisements due to non-payment).4.6 A penalty fee of R35.00 is charged for unpaid Debit Orders and will be included on your following payment.4.7 Registration and placement of your Advert on the site constitutes authorization to Debit your account for advertised amount.4.8 Should Advertising rates be increased at any time Advertisers will be notified by email at least One (1) month in advance. 4.9 Should an Advertiser wish to remove their advertisement, we require a 14 working days notice period prior to the next payment date by means of an email sent to accounts@corporateguru.co.za

5. Payment Methods

5.1. Payment are done via Debit Order One (1) month in advance.5.2. Payments are managed by Stratcol Debit Orders.

6. Competitions

6.1. Corporate Guru will assume no responsibility for any Competitions advertised by Suppliers or service Providers or any responsibility for prizes awarded. The Competition is solely at the discretion of the company hosting the competition and of the person entering the competition. Should you be a Winner you agree by entering the Competition that your name can be listed on the site as a Winner.

7. Click Reports

A click Report will be available to each Advertiser recording the number of click-to-site generated from Corporate Guru. Thereafter no responsibility is assumed for culmination of any transactions between yourself and the client. 

8. Disclaimer

8.1. Save for Corporate Guru being liable to you:
8.1.1. under Section 61 of the CPA in relation to any products sold by Corporate Guru to you via the Website; and
8.1.2. under sections 43(5) and 43(6) of the ECT Act in relation to Corporate Guru payment systems not being sufficiently secure, each of Corporate Guru and the User ("Indemnifying Party") hereby indemnifies and holds harmless the other, and its respective trustees or directors, as the case may be, officers and employees, (collectively, the "Indemnified Parties"), from and against any and all claims, actions, liabilities, damages, costs and expenses asserted against, imposed upon or incurred by the Indemnified Parties as a result of or arising out of any contravention of the CPA (collectively, "Loss") proven under the CPA by a consumer himself or herself, or other person contemplated in section 4(1) of the CPA, save to the extent that any such Loss is due to the negligent or intentional conduct of the Indemnified Parties.
8.2. Notwithstanding the provisions of clause 8.1, the Indemnifying Party shall in no event be liable to the Indemnified Parties for Loss in relation to indirect, special or consequential damages, other than that contemplated in Section 61 of the CPA.
8.3. The Indemnified Party shall promptly notify the Indemnifying Party of any Loss in respect of which an Indemnified Party intends to claim indemnification under this indemnity
8.4. Products sold via the Website itself are supplied on an "as is" basis and have not been compiled or supplied to meet your individual requirements but rather the requirements of Section 55(2) of the CPA. It is your sole responsibility to satisfy yourself prior to accepting these Terms that the products available from and through this Website will meet your individual requirements.
8.5. Information, ideas and opinions expressed on this Website should not be regarded as professional advice or the official opinion of Corporate Guru and you are encouraged to consult professional advice before taking any course of action related to information, ideas or opinions expressed on this Website.

9. Governing Law and Jurisdiction

This Website is hosted, controlled and operated from the Republic of South Africa and therefore governed by South African law and, subject to the 'Disputes' clause of these Terms, you and Corporate Guru submit to the non-exclusive jurisdiction of the South African courts.

10. Privacy

10.1. Corporate Guru shall take all reasonable steps to protect your personal information. Corporate Guru has placed physical, technological and procedural security safeguards in place that comply with best practices to protect personal information about the user.
10.2. For the purpose of this clause, "personal information" shall bear the meaning as defined in the Promotion of Access to Information Act 2 of 2000 ("PAIA"). PAIA may be downloaded from:http://uscdn.creamermedia.co.za/assets/articles/attachments/03569_promofaccestoinfoact2.pdf.
10.3. Corporate Guru may electronically collect, store and use the following of your personal information:
10.3.1. name and surname;
10.3.2. birth date;
10.3.3. gender;
10.3.4. country of residence;
10.3.5. closest city;
10.3.6. e-mail address;
10.3.7. mobile number (if provided by you);
10.3.8. IP address; and
10.3.9. ID number / passport number.
10.4. Corporate Guru collects, stores and uses the abovementioned information for the following purposes:
10.4.1. to greet you when you access the Website;
10.4.2. subject to your consent, to inform you of facts relating to your access and use of the Website;
10.4.3. subject to your consent, to inform you about competitions and special offers from Corporate Guru and/or its partners / affiliates;
10.4.4. to compile non-personal statistical information about browsing habits, click-patterns and access to the Website;
10.4.5. to verify your identity when transacting with Corporate Guru; and
10.4.6. to ensure that the goods are received by the addressee.
10.5. You may elect not to receive any communications from Corporate Guru and/or its partners/affiliates.
10.6. Corporate Guru may collect, maintain, save, compile, process and share any information collected from you, subject to the following provisions:
10.6.1. Corporate Guru shall not disclose your personal information unless:
10.6.1.1. you consent thereto;
10.6.1.2. through due legal process;
10.6.1.3. Corporate Guru may compile, use and share any information that does not relate to any specific individual; and
10.6.1.4. Corporate Guru owns and retains all rights to non-personal statistical information collected and compiled by Corporate Guru.
10.7. You acknowledge and agree that certain personal information (i.e. your full names, delivery address, email address, and contact number) will be disclosed to third parties in order to enable delivery of such products to you and to facilitate communication in relation to your purchase of such products.

11. Security

11.1. Any person that delivers or attempts to deliver any damaging code to this Website or attempts to gain unauthorised access to any page on this Website shall be prosecuted and civil damages shall be claimed in the event that Corporate Guru suffers any damage or loss.
11.2. You agree and warrant that your log-in name and password shall:
11.2.1. be used for your personal use only; and
11.2.2. not be disclosed to any third party.
11.3. You allow Corporate Guru to take all reasonable steps to ensure the integrity and security of the Website and back-office applications.
11.4. No bank details or credit card details are stored by Corporate Guru. Corporate Guru agent Stratcol is responsible for the storage thereof and has their own security policy.

12. Cookies

12.1 Corporate Guru uses cookie and tracking technology.
12.2 Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the Site, and understanding how visitors use the Site. Cookies can also help customize the Site for visitors.
12.3 Personal information cannot be collected via cookies and other tracking technology; however, if you previously provided personally identifiable information, cookies may be tied to such information.
12.4 Aggregate cookie and tracking information may be shared with third parties.

13. Changes to Agreement

Corporate Guru may, in its discretion, change these Terms or any part thereof at any time and will use its best endeavours to notify you of said changes at the email address provided by you. Should you not be satisfied with the amendments, you must refrain from placing any further orders on, or from using in any way, the Website.

14. Disputes

Save for urgent or interim relief which may be granted by a competent court, in the event of any dispute of any nature whatsoever arising between you and Corporate Guru on any matter provided for in, or arising out of these Terms shall be dealt with by any Ombud or other dispute resolution mechanism in terms of the Consumer Protection Act, or the National Consumer Commission

15. Term and Termination

These Terms shall commence from the date on which they are published on the Website and continue indefinitely, as amended by Corporate Guru from time to time (as described above), for so long as the Website exists and is operational, Corporate Guru being entitled to terminate these Terms and/or shut down the Website at any time.

16. Copyright & other Intellectual Property Rights

16.1. Any and all copyright subsisting in the Website, including these Terms, vests in Corporate Guru and all rights not expressly granted are reserved.
16.2. All the content, trademarks and data on this Website, including but not limited to, software, databases, text, graphics, icons, hyperlinks, private information, designs and agreements, are the property of or licensed to Corporate Guru and as such are protected from infringement by local and international legislation and treaties.

17. Electronic Communications

When you visit the Website or send e-mails to Corporate Guru, you consent to receiving communications from Corporate Guru electronically and agree that all agreements, notices, disclosures and other communications sent by Corporate Guru satisfy any legal requirements, including but not limited to the requirement that such communications should be "in writing".

18. Hyperlinks, Framing, Spiders & Crawlers

18.1. Hyperlinks provided on this Website to non-Corporate Guru sites are provided as is and Corporate Guru does not necessarily agree with, edit or sponsor the content on such web pages.
18.2. No person, business or web site may frame this site or any of the pages on this Website in any way whatsoever.
18.3 No person, business or web site may "scrape" or otherwise crawl this site for the purposes of gaining information other than that necessary to provide links back to the site from a search engine.

19. Information

19.1. The ECT Act states that when goods or services are offered by way of certain electronic transactions, the seller thereof must make certain information about it available to customers on websites where the goods or services are offered.
